Terms of Service

1. Introduction and Acceptance

These Terms of Service ('Agreement') govern the use of the DGMOS website, mobile applications, and SaaS platform services ('Service') provided by Delaware/USA-based DGMOS DG REGTECH C Corp and its Turkish local representation DG REGTECH SÜRDÜRÜLEBİLİRLİK YAZILIM ANONİM ŞİRKETİ (together referred to as 'DGMOS' or 'Company'). By registering on the platform, creating an account, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

2. Service Description

DGMOS is a SaaS service providing a digital operations platform for dangerous goods logistics, facility management, and regulatory compliance. The scope of the Service includes but is not limited to:

• •Platform Modules: Compliance and regulation, logistics and trip management, field inspections, document automation, and AI-assisted processes.
• •Integrations: Data exchange with UETDS, e-Government, and third-party ERP/WMS systems.
• •Support and Updates: Technical support, platform updates, and content updates for regulatory changes depending on your subscription plan.

3. Account Registration and Security

To use the Service, you must create an account with valid and accurate information. You are responsible for the security of your account:

• •Accurate Information: Corporate and personal information provided during registration must be current and accurate.
• •Password Security: It is your responsibility to keep your account password confidential and take necessary measures to prevent unauthorized access.
• •Authorization: For corporate accounts, correctly assigning roles and permissions, and ensuring employees use the platform only within their authorized scope is the account holder's responsibility.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with this Agreement. The following actions are strictly prohibited:

• •Unauthorized Access: Attempting unauthorized access to the platform, other user accounts, or system infrastructure.
• •Abuse: Using the Service to distribute malware, send spam, or compromise platform security or performance.
• •Data Violation: Uploading or sharing content that infringes third-party intellectual property rights or personal data.
• •False Data: Intentionally entering false or misleading data for legal notifications, audit records, or transport documents.

5. Subscription, Payment and Billing

DGMOS Service is offered on a subscription model. Payment and billing terms are as follows:

• •Plan and Pricing: Your active subscription plan is determined by the selected module package and number of users. Current prices are shared on our website or by our sales team.
• •Billing Period: Subscription fees are collected in advance monthly or annually according to the selected plan. Failure to pay may result in suspension of Service access.
• •Refund Policy: Due to the nature of digital SaaS services, no refunds are provided after active use has begun. Legal obligations and special agreements are reserved.

6. Intellectual Property Rights

All software code, interface design, brand, logo, documentation, and content of the DGMOS platform belong to DGMOS or its licensors. Users are granted a limited use license for personal or corporate operational purposes only during the Service period. The following are prohibited:

• •Reverse engineering, copying, or redistributing platform code.
• •Using the DGMOS brand, logo, or content for commercial purposes without written permission from the Company.

7. Service Availability and Limitation of Liability

DGMOS makes reasonable efforts to ensure uninterrupted and error-free operation of the Service; however, it does not accept liability for the following:

• •Planned Maintenance: Temporary interruptions during planned maintenance and updates notified in advance.
• •Force Majeure: Circumstances beyond control such as natural disasters, cyber attacks, infrastructure provider failures, or official authority decisions.
• •Operational Decisions: Consequences arising from business or legal decisions made by the user based on data entered into the platform. DGMOS does not provide consulting or legal advice; regulatory compliance is the user's own responsibility.

8. Termination

Either party may terminate this Agreement under the following conditions:

• •By User: You may terminate your subscription at any time through account settings or by written notice to [email protected]. Termination takes effect at the end of the current billing period.
• •By DGMOS: In case of violation of usage rules, non-payment, or legal obligations, your account may be suspended or terminated with prior notice, or immediately in emergency situations.

9. Governing Law and Contact

For disputes arising from this Agreement, Turkish law applies for users in Turkey, and Delaware/USA law applies for international users. You can contact us for questions and notices:
